This website is owned and operated by or on behalf of GODS TRUST (‘GODS TRUST’) under the domain name www.godstrust.co.in (the GODS TRUST Website).

Your use of the Service (provided by GODS TRUST), the II Website, and the information, graphics, materials and any products or services offered on the GODS TRUST Website (‘Material on this Website’) is governed by these Terms and Conditions and the associated Security & Privacy Policy.

By using the GODS TRUST Website you agree to be bound by these Terms and Conditions and the Security & Privacy Policy.

Definitions

• Bank Account means a valid deposit, checking or savings account with a financial or deposit-taking institution. Electronic Instruction means any electronic instruction, information, message, request or communication issued or transmitted to GODS TRUST through the GODS TRUST Website.
• Material on the GODS TRUST Website means any tools, calculation devices, software programs, games or other features which may assist you in conducting Payment transactions or helpful hints or other information, which may be available on the GODS TRUST Website.
• Nominated Card means a valid credit or charge card which You may use to transfer funds from as a Sender.
• Nominated Debit Account means a Bank Account which you may use to transfer funds from as a Sender.
• Payment means a transfer of funds from you to GODS TRUST via the GODS TRUST Website towards a charitable donation or for the purchase of products and services offered by IIMPACT.
• Service means the use of the GODS TRUST Website to access information relating to GODS TRUST’s activities, communicating with GODS TRUST staff or other registered users on community forums or posting your comments on the GODS TRUST blog or other online forums.
• You means the person who accepts and agrees to be bound by these Terms and Conditions, and in the case of a business, are binding the legal entity which operates that business, (whether that be a sole trader, partnership or incorporated body) and represent that you have authority to bind that business in this fashion.

Receipt of Payments

The legal entity accepting payments on this Website is referred to as ‘GODS TRUST’ and registered as follows:

• Registration Indian Trust Act
• The 12A registration
• The 80G registration

Donors in India

Donors in India can either donate through the website or send a cheque directly to the honorary Managing Trustee/ Secretary at the head office address.

Donors domiciled in India may be entitled to a 50% rebate under 80G of the Income Tax. Act 1961 on their donation to GODS TRUST. GODS TRUST will provide a receipt for each donation if you have provided your full postal address to the treasurer by e-mail.

Registering to use the Service

You must register with GODS TRUST in order to use the Services. You do NOT need to register to make a payment as donation to GODS TRUST. If you do not register with GODS TRUST, you may be able to authorize Payments, but not all of the features of the Service or the GODS TRUST Website will be available to you. When registering with GODS TRUST, You must provide us with certain details, including, but not limited to, your:

1. Your Name
2. Valid and active email address
3. If You wish to make Payments:

• By credit card, a credit card number (and expiry date and card type), which will be your Nominated Card, and a signed authorization form to charge amounts to your Nominated Card in accordance with your instructions when you use the Service
• By direct debit, a Bank Account number, which will be your Nominated Debit Account, and a signed authorization form to withdraw funds from your Nominated Debit Account.

If you successfully register with Payment, You will be provided with a unique username and password. You will be required to enter this username and password each time you use the Service or certain sections of the GODS TRUST Website.

Updating your profile

If you are a registered user of the Service, You may update your profile at any time via the Change Profile section of the GODS TRUST Website. GODS TRUST may take steps to verify any changes to the information we hold about you before processing or relying on that information.

Making Payments

You may initiate an online Payment to GODS TRUST by providing the required information at the GODS TRUST Website. This required information includes, but is not limited to:

1. Your name, address and email address
2. The amount of the Payment
3. The credit card or bank account details to be debited.

GODS TRUST will only process a Payment transaction when it has received an authorization by Electronic Instruction from You directing GODS TRUST to transfer funds. You must have adequate funds available in your Nominated Debit Account or on your Nominated Card in order for the transaction to be processed. If You do not, then GODS TRUST may recover from You any exception processing fees it incurs from any Bank or other financial institution. GODS TRUST may deduct these amounts from any of your accounts, the details of which you have provided to GODS TRUST, without any notice to you.

Your financial institution may charge you a fee for the Payment processed by GODS TRUST to your nominated Card or Nominated Debit Account. GODS TRUST will not be liable for such fees and charges.

If You are a registered user of the Service, GODS TRUST will keep a record of the Payment transaction associated with your username for the period specified. However you are responsible for your own record keeping for financial planning, taxation or other purposes. To request a receipt for a payment to be sent to you, please provide a mailing address when making a donation and request a receipt by emailing godstrust09@gmail.com.

Cancelling Payment

You may cancel certain Payments that have not yet been processed by GODS TRUST by contacting us within 3 days of authorizing the Payment. GODS TRUST may charge you a fee for cancelling the Payment. If the Payment cannot be cancelled as set out above, You cannot reclaim the Payment by initiating a chargeback via your financial institution.

Your other obligations

You represent and warrant that all information You provide to GODS TRUST will be complete, correct and accurate in every particular. If you provide incorrect or inaccurate information, your ability to use the Service and the GODS TRUST Website may be suspended.

You agree and warrant that You will only use the Service and the GODS TRUST Website for bona fide and lawful purposes. You must not seek to access or alter any information on this site to which you do not have authorization. In addition, you must not seek to use any software or electronic device to overload crash or interfere with our system.

You agree and warrant that You will not use the Service or the GODS TRUST Website in connection with any products or services that GODS TRUST reasonably consider are illegal or brand damaging.

You may not distribute, modify, transmit, and repost for commercial purposes, Materials on this Website without written permission of GODS TRUST.

If you are a registered user of the Service, GODS TRUST identifies You via your username and password. You agree to not disclose your username and password to any other person, and You also agree not to use any other person’s username and password. You must take all reasonable steps to keep your username and password confidential and secure. If, in breach of this clause, You do provide another person with your username and password, or do not take reasonable steps to keep your username and password confidential and secure, then You will be taken to have authorized any use of your account by that person.

If your username and/or password is lost, stolen or security is compromised in any way, or You suspect this to be the case, then You must notify GODS TRUST immediately.

The GODS TRUST Website may contain links to websites which are owned or operated by third parties independent of GODS TRUST (Linked Websites). GODS TRUST does not sponsor, endorse, or approve of the operators of Linked Websites, or material which is located on Linked Websites, including special offers, deals or promotions, or information, graphics and other material (Third Party Material).

Subject to any applicable law which cannot be excluded, GODS TRUST makes no warranties or representations:

1. Regarding the quality, accuracy, merchantability or fitness for purpose of Third Party Material, or products or services available through Linked Websites
2. That Third Party Material does not infringe the intellectual property rights of any person. GODS TRUST is not authorizing the reproduction of Third Party Material by linking Material on this Website to Third Party Material.

When following a link on the GODS TRUST Website, material at a Linked Website may be displayed in your browser framed by Material on this Website. This material is also Third Party Material for the purpose of these Terms of Use.

Warranties

Limitation of Liability

You indemnify GODS TRUST in respect of any liability incurred by GODS TRUST for any loss or damage, howsoever caused, suffered by GODS TRUST as a result of your breach of these GODS TRUST Website Terms and Condition, or your use of the GODS TRUST Website or any products or services offered on the GODS TRUST Website.

Availability of the GODS TRUST Website

As electronic services are subject to interruption or breakdown, access to the GODS TRUST Website is offered on an ‘as is’ and ‘as available’ basis only. You agree to submit to the non-exclusive jurisdiction of the courts of India as applicable above.

Should any clause or part thereof of these Terms and Conditions be found to be void, unenforceable or invalid, then it is severed from this agreement, leaving the remainder in full force and effect, provided that the severance has not altered the basic nature of this agreement.
